For a P2P platform that is busy applying for a telecom business license, should it be an ICP certificate or an EDI certificate? This is a question.
Recently, the relevant authorities of the Ministry of Industry and Information Technology (hereinafter referred to as the Ministry of Industry and Information Technology) responded: There is only one license that the P2P platform needs to apply for in the telecommunications sector, that is, the "Value-added Telecom Business Operation License"; among the various business forms of the license, P2P corresponds to the item of "online data processing and transaction processing", but this license is not equivalent to the EDI certificate that has been circulated before; License" possibility.
Previously, the market generally judged that since the P2P platform is an information intermediary, it should apply to the local communications administration for an ICP license. However, some media reported in mid-September that ICP is not a license required for P2P. What is really required is an online data and transaction processing license, which is equivalent to an EDI license.
"EDI's statement is definitely inaccurate," a relevant authority from the Ministry of Industry and Information Technology told Zhiwei Technology that there were two levels of misreading in the previous market interpretation.
The first misunderstanding is that the Ministry of Industry and Information Technology has not yet ruled out the possibility of ICP licensing, and the specific judgment will have to wait for the CBRC to issue the "Guidelines for Online Lending Filing and Registration". The person said that after completing the level filing of the local financial supervision department, there is only one license that the P2P platform needs to apply to the local communications administration, that is, the "Value-added Telecom Business Operation License"; among the various business forms of the license, The corresponding P2P platform should be "online data processing and transaction processing"; however, the possibility of applying for "Internet Information Service Business Operation License", that is, "ICP Certificate", has not yet been ruled out.
The person further explained that the P2P regulatory measures enumerate the services provided by the platform, including information publication, information exchange, loan matching, etc. "But we have to wait for the CBRC to clarify whether the platform must have these services." The aforementioned person said that if it only involves matching services and does not include information disclosure and interaction, then only the online data processing and transaction processing business licenses need to be applied; but if it is clear that all P2P platforms cover services such as publication, interaction and matching, then It is necessary to apply for the above two services at the same time.
第二个误读是，不能将“在线数据处理与交易处理”等同于EDI。据《电信业务分类目录(2015年版)》，EDI对应的“电子数据交换”，属于在线数据处理与交易处理业务中的一种。除了EDI，在线数据处理与交易助理业务还包括了交易处理业务、网络/电子设备数据处理等另外两项业务内容。该人士表示，P2P平台的业务形态更加倾向于其中的“交易处理业务”，而EDI一般对应的是海关、税务等处于国际标准数据格式的报表、保单业务，“跟P2P没有任何关系”。
笔者了解到，部分P2P平台在申请相关许可证时，所花费时间较长。对此，该人士表示，近两年对申请材料的要求有所简化，企业补证的次数明显减少：此前平均补证3次，现在只要1.2次，而补证时间大概在10个工作日左右。根据规定，电信管理机构会在收到申请之日起的60日内完成审查工作，且省管局审批环节相对简单，一般低于法定期限。并且，如果选择同时申请上述两项业务，除提交的服务项目表单有所区别外，其它附件性材料均是相同的，无需重复提交。
值得注意的是，对于某些已经同时拿到两项业务许可的平台来说，事情可能并未完全结束。由于此前各地政策不同，部分平台在申请《增值电信业务经营许可证》时，并未进行金融监管部门的登记备案。该人士指出，类似许可证仅涵盖一般性服务，而不包括行业专项管理的服务。因此，建议平台到地方金融监管当局补办备案登记，再去地方信管局进行服务项目的变更。
