Article 2 The enterprise technology center referred to in these Measures refers to the technology research and development and innovation institution established by the enterprise according to the needs of market competition. It is responsible for formulating enterprise technological innovation plans, carrying out industrial technology research and development, creating and applying intellectual property rights, establishing technical standard systems, and cohesive training. Innovate talents, build collaborative innovation networks, and promote the implementation of the entire process of technological innovation.

Article 3 Encourage and support enterprises to establish technology centers, give full play to the main role of enterprises in technological innovation, and establish and improve systems and mechanisms for enterprises to lead industrial technology research and development innovation. In accordance with the requirements of innovation-driven development and the needs of economic structural adjustment, enterprise technology centers with strong innovation capabilities, good innovation mechanisms, large leadership and demonstration roles, and qualified enterprise technology centers will be identified, and policy support will be provided to encourage and guide key industry enterprises to drive industrial technological progress and innovation. Article 4 The Municipal Economic and Information Technology Bureau, Municipal Development and Reform Commission, Municipal Science and Technology and Talent Bureau, Municipal Finance Bureau, Municipal Taxation Bureau, and Luzhou Customs are responsible for guiding and coordinating the work related to the Municipal Enterprise Technology Center. The Municipal Economic and Information Technology Bureau takes the lead in carrying out the identification and operation evaluation of the municipal enterprise technology center.

The economic and informatization departments of each county (district) and park are responsible for the application, management and other matters of the municipal enterprise technology center.

Chapter 2 Determination

Article 5 The recognition of the Municipal Enterprise Technology Center shall, in principle, be organized once a year. The economic and information administrative departments of each county (district) and park shall organize enterprise declarations in accordance with the requirements of the notice of the Municipal Economic and Information Technology Bureau.

Article 6 Enterprises applying for the Municipal Enterprise Technology Center should meet the following basic conditions:

(1) An enterprise registered within the administrative area of ​​Luzhou City with independent legal personality.

(2) The enterprise has significant development advantages and competitive advantages in the industry, and has strong technological innovation capabilities and levels.

(3) It has a good technological innovation mechanism, the enterprise technology center organizational system is relatively complete, the innovation efficiency is high, the innovation benefits are good, and it has certain innovation results.

(4) Have high investment in research and development, with annual research and experimental development expenditures of no less than 1.5 million yuan; have technical leaders with high technical levels and rich practical experience, and have no less than 15 full-time research and experimental development personnel. people; R&D investment and the number of research and test development personnel are not lower than the industry average.

(5) Have relatively complete research, development, and testing conditions, and the original value of technology development instruments and equipment is not less than 1.5 million yuan; have good technology accumulation, pay attention to the development of cutting-edge technologies, and have the ability to carry out high-level technological innovation activities.

(6) A corporate technology center has been established and has been operating normally for more than one year.

(7) An enterprise shall not have the following circumstances within two years before the deadline for application acceptance:

1. Violating the Tax Collection and Administration Law and relevant laws and administrative regulations, constituting tax evasion, fraudulent export tax refunds and other serious tax violations;

2. Subject to criminal or administrative penalties for violating customs laws and relevant laws and administrative regulations, constituting smuggling, or subject to administrative penalties for serious violations of customs supervision regulations;

3. Large or above quality, environmental protection and safety accidents occur mainly due to technical reasons;

4. Other serious illegal and untrustworthy acts determined by judicial and administrative agencies.

(8) Appropriately relax indicator requirements for new business formats and new model enterprises under the new situation.

Article 7 Municipal Enterprise Technology Center Recognition Procedure:

(1) The enterprise applies to the economic and information technology departments of the county (district) and park where it is located and submits the application materials as required. The application materials include: "Luzhou Enterprise Technology Center Application Report" and "Luzhou Enterprise Technology Center Evaluation Data Sheet" and necessary supporting materials.

(2) The economic and information technology departments of each county (district) and park will review the application materials submitted by the enterprises, determine the list of recommended enterprises in accordance with these measures and the notice issued by the Municipal Economic and Information Technology Bureau of the year, and will list the recommended enterprises. The application materials and review opinions (in triplicate) shall be submitted to the Municipal Economic and Information Technology Bureau within the specified time.

(5) The Municipal Economic and Information Technology Bureau, together with the Municipal Development and Reform Commission, the Municipal Science and Technology and Talent Bureau, the Municipal Finance Bureau, the Municipal Taxation Bureau, and Luzhou Customs, will conduct a comprehensive evaluation based on national industrial policies, preliminary evaluation results, expert evaluation opinions, and on-site inspections. Article 11 The evaluation results of the Municipal Enterprise Technology Center are divided into excellent, good, basically qualified and unqualified:

(1) An evaluation score of 90 points or above is considered excellent;

(2) An evaluation score of 75 to 90 points (excluding 90 points) is considered good;

(3) An evaluation score of 60 to 75 points (excluding 75 points) is basically qualified;

(4) An evaluation score below 60 is considered unqualified.

Article 12 The Municipal Economic and Information Technology Bureau, together with the Municipal Development and Reform Commission, the Municipal Science and Technology and Talent Bureau, the Municipal Finance Bureau, the Municipal Taxation Bureau, and Luzhou Customs, shall review and confirm the evaluation results.

Article 13 If the name of the enterprise where the Municipal Enterprise Technology Center is located changes, reorganization, etc., the change shall be reported to the local county (district), park economic and information technology department within 90 days after the name change, reorganization, etc. of the enterprise. According to the situation, the economic and information technology departments of each county (district) and park will promptly report the name change, reorganization and other changes of the enterprise where the municipal enterprise technology center is located to the Municipal Economic and Information Technology Bureau. The Municipal Economic and Information Technology Bureau, together with the Municipal Development and Reform Commission, the Municipal Science and Technology and Talent Bureau, the Municipal Finance Bureau, the Municipal Taxation Bureau, and Luzhou Customs, annually review the municipal enterprise technology reports submitted by the economic and information administrative departments of each county (district) and park. Article 14 The economic and informatization departments of each county (district) and park are responsible for the daily operation supervision of the enterprise technology center in the municipality.

(2) Responsible for giving yellow card reminders to municipal enterprise technology centers that are evaluated as basically qualified and guiding and urging them to improve.

(3) Supervise municipal enterprise technology centers that have been evaluated as unqualified or have not submitted evaluation materials overdue to make rectifications. The rectification period is one month. After passing the initial review during the rectification period, they can apply for re-evaluation.

Article 15 If any of the following circumstances occurs, the qualification of the Municipal Enterprise Technology Center will be revoked:

(1) The operation evaluation is unqualified, and the evaluation is still unqualified after rectification;

(2) Deliberately falsify and provide false materials and data;

(3) Major or higher quality, environmental protection, and safety accidents occur mainly due to technical reasons;

(4) Subject to criminal or administrative penalties for violating customs laws and relevant laws and administrative regulations, constituting smuggling, or subject to administrative penalties for serious violations of customs supervision regulations;

(5) Violating the Tax Collection and Administration Law and relevant laws and administrative regulations, constituting tax evasion, fraudulent export tax refunds and other serious tax violations;

(6) Other serious illegal and untrustworthy acts determined by judicial and administrative agencies;

(7) The enterprise is terminated according to law.

Article 16 If the municipal enterprise technology center qualification is revoked due to the reasons listed in items (2) to (6) of Article 15 of these Measures, the economic and information technology director of each county (district) and park will be responsible for the cancellation from the date of revocation. The department shall not recommend the enterprise to apply for the Municipal Enterprise Technology Center again within two years.

Article 17 The renamed and canceled Municipal Enterprise Technology Center will be announced once a year.

Chapter 4 Encouragement Policies

Article 18 The Municipal Economic and Information Technology Bureau, the Municipal Development and Reform Commission, the Municipal Science and Technology and Talent Bureau, the Municipal Finance Bureau, the Municipal Taxation Bureau, and Luzhou Customs shall provide support to the Municipal Enterprise Technology Center in accordance with the law in conjunction with the innovation capacity building of the enterprise technology center. .

Article 19: Support the Municipal Enterprise Technology Center to undertake the research and development tasks of local fiscal science and technology plans (special projects, funds, etc.).

Article 20 Enterprises applying for provincial enterprise technology center recognition should in principle be municipal enterprise technology centers. Municipal enterprise technology centers with excellent evaluation results will be given priority to apply for provincial enterprise technology centers.

Chapter 5 Supplementary Provisions

Article 21 The economic and information technology departments of each county (district) and park can refer to these measures and combine local realities to formulate corresponding policies in accordance with the law within the scope of their responsibilities to support the construction of enterprise technology centers.

Article 22 The content and requirements of the application materials, evaluation materials and evaluation index system involved in these measures shall be determined by the Municipal Economic and Information Technology Bureau in consultation with the Municipal Development and Reform Commission, Municipal Science and Technology and Talent Bureau, Municipal Finance Bureau, Municipal Taxation Bureau, Luzhou Customs will issue a separate announcement later and adjust it accordingly.

Article 23 These Measures are interpreted by the Municipal Economic and Information Technology Bureau in conjunction with the Municipal Development and Reform Commission, the Municipal Science and Technology and Talent Bureau, the Municipal Finance Bureau, the Municipal Taxation Bureau, and Luzhou Customs.

Article 24 These Measures will come into effect on April 30, 2023, and will be valid for 5 years. The original "Luzhou Enterprise Technology Center Management Measures" (Luzhou Jingxin Chuangfu [2018] No. 147) was abolished at the same time.
