Article 243 [ Crime of false accusation and frame -up ] fabricating facts to falsely accuse and frame others, with the intent to subject others to criminal investigation, if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance; if serious consequences are caused, he shall be sentenced to not less than three years and ten years imprisonment for less than one year.
Staff of state organs who commit the crime mentioned in the preceding paragraph shall be given a heavier punishment.
The provisions of the preceding two paragraphs do not apply to those who do not intend to make a false accusation, but make a false accusation, or make a false accusation.
